Terms of Service

1. Acceptance of Terms

By accessing or using KaiMail ("Service"), operated by Kafkai Giken, Inc. ("Company", "we", "us"), you ("user", users") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. Please review the agreement carefully. Once accepted, it will be a binding legal commitment.

2. Description of Service

KaiMail is an email forwarding service that allows users to receive and send emails using their own custom domains. The Service includes email routing, ARC/DKIM signing, webhook delivery, and related features as described on our website.

3. Account Registration

To use the Service, you must create an account by providing a valid email address and other required information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and current registration information
  • Notifying us immediately of any unauthorized use of your account
  • The Company may refuse registration or cancel your account at its discretion if you are deemed an inappropriate user, and you shall have no right to object to such decision.
  • You must promptly update your account information if any changes occur.
  • Certain features of the Service, such as DNS configuration for custom domains and webhook integration, require technical knowledge. Support is provided exclusively via email.

4. Subscription Plans and Billing

  • The Service offers multiple subscription plans with varying features and limits as described on our Pricing page.
  • Paid plans are billed monthly in Japanese Yen (JPY). All prices are tax-inclusive.
  • Payment is due at the beginning of each billing cycle.
  • You may cancel your plan at any time through your account settings.
  • Refunds or pro-rated pricing are not provided for partial billing periods.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

  • In any way that violates applicable laws or regulations
  • To send unsolicited bulk email (spam)
  • To distribute malware, viruses, or other harmful content
  • To infringe upon the intellectual property rights of others
  • To impersonate any person or entity
  • To transmit content that is defamatory, harassing, or constitutes slander against any person or entity
  • To transmit content that is obscene, violent, or discriminatory
  • To transmit content that violates public order or morals
  • To transmit false or misleading content
  • To use the Service in any way that violates these Terms in letter or in spirit

6. Prohibited Activities

The following activities are strictly prohibited:

  • Using the Service to relay, forward, or amplify spam
  • Attempting to bypass rate limits or usage quotas
  • Interfering with or disrupting the Service or its infrastructure
  • Reverse engineering, decompiling, or disassembling any part of the Service
  • Reselling or redistributing the Service without our written consent
  • Using the Service to engage in phishing or fraud

If the Company determines that a user has engaged in any of the above prohibited activities, the Company may, at its sole discretion and without prior notice, suspend or terminate the user's account, delete data, or take any other measures deemed necessary. The Company shall bear no responsibility for any damages incurred by the user as a result of such measures.

7. Intellectual Property

The Service, including its design, code, features, and documentation, is the property of Kafkai Giken, Inc. and is protected by intellectual property laws. Your use of the Service does not grant you any ownership rights.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may temporarily suspend the Service for maintenance, updates, or other operational reasons. We are not liable for any downtime or service interruptions.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability shall not exceed the amount you paid for the Service during the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

We do not warrant that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from use of the Service will be accurate or reliable
  • Any errors in the Service will be corrected

12. Termination

  • You may terminate your account at any time by contacting us or through your account settings.
  • We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion, with or without notice.
  • Upon termination, your right to use the Service ceases immediately, and your data may be deleted.

13. Elimination of Anti-Social Forces

You represent and warrant that you are not a member of anti-social forces (gang, gangster, someone who have not passed the five years from the time that is no longer in the gangster, gang quasi-members, gang related companies, racketeers, etc., social movements such as advocating grounder or special intelligence violence groups, and other means a person pursuant to this.), or, those who relates, cooperates or involved in with anti-social forces and its maintenance operation or management through funding or such.

In the case that the Company has reasons to believe that you are a member of anti-social forces, the Company may immediately suspend the provision of the Service and terminate your account or take other measures that the Company deems appropriate without requiring any prior notification to you. The Company shall bear no responsibility for any damages incurred by you as a result of such suspension or termination.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court.

15. Changes to These Terms

The Company may change these Terms at its discretion. When changes are made, the revised Terms shall take effect at the time they are posted on the Service's website. We will notify you of material changes by posting the updated Terms on our website and, where practicable, by email. Your continued use of the Service after such changes have been posted constitutes your acceptance of the revised Terms. If you do not agree with any changes, you must stop using the Service.
